Instructions on withdrawal & withdrawal form

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession:

Please note: Different rules apply to goods and to digital content — in particular regarding when the withdrawal period begins. The section that matches your order is the one that applies.

A. Instructions on withdrawal for goods

Applies to plush animals, jewellery, gift boxes and all other physical items.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (aninu, Achwaldstraße 4d, 80999 München, Deutschland, E-Mail: hello@aninu.de) by means of a clear declaration (e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

B. Instructions on withdrawal for digital content

Applies to digital animal sponsorships, certificates and digital content in the aninu app.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of conclusion of the contract.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

There is nothing to return, as this concerns digital content. You do not owe us any compensation for value in respect of the use of the digital content.

Premature expiry of the right of withdrawal

Your right of withdrawal for contracts on the supply of digital content not supplied on a tangible medium expires prematurely if all four of the following conditions are met:

we have begun performance of the contract,
you have expressly consented to us beginning performance of the contract before the withdrawal period has expired,
you have confirmed your awareness that, by giving this consent, you lose your right of withdrawal once performance of the contract begins, and
we have provided you with a confirmation of this on a durable medium.

This applies in particular to the creation of a digital certificate that is generated at your request after purchase. We obtain your express consent and the confirmation of your awareness of the loss of the right of withdrawal immediately before the certificate is created, by means of a separate checkbox that is not pre-ticked. We send you the confirmation on a durable medium by email immediately after creation.

C. General notes

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us carriage forward.
3) Please note that points 1-2 above are not a precondition for the effective exercise of the right of withdrawal.
